On August 14, 2008, the Consumer Product Safety Improvement Act (CPSIA) was signed into law by President Bush. This new legislation has manufacturers and retailers of all consumer goods on high alert, as they attempt to determine how to ensure complete regulatory compliance and brand protection during a recall. Components of New Consumer Product Safety Legislation

  • Increases authority of the Consumer Product Safety Commission (CPSC)
  • Significantly increases financial and criminal penalties for noncompliant companies
  • Safety standards previously considered voluntary are now mandatory
  • Manufacturers are prohibited from producing noncompliant products
  • Retailers are prohibited from selling or offering to sell recalled product at the store level
  • Recalled product must be promptly and completely removed from store shelves
  • Testing and registration required for certain categories of juvenile products
  • Recalling companies must report supplier and delivery information via public database
